Matrimonial proceedings

Remission of stamp duty is allowed on documents executed to transfer a property resulting from a proceeding for a decree of divorce, judicial separation or nullity of marriage under the law or religion.

Eligibility for Remission

• The transfer is a result of a compliance with any order of court for division of matrimonial assets
• Property must be transferred to the other party to the matrimonial proceedings, any child or children of the marriage or former marriage of the parties to those proceedings

List of supporting documents required for application

• Copy of duly executed document of transfer
  
• Copy of the final court order or decree nisi absolute
• Documents to show the relationship between the transferor and transferee
